Service Provider Terms of Service

1. Acceptance of Terms

By creating an account and using the BookingAddOn™ platform as a service provider (the "Service"), you agree to be bound by these Service Provider Terms of Service ("Terms"). The Service is owned and operated by BookingAddOn™, a company incorporated under the laws of Panama. If you do not agree with these Terms, you must not use the Service.

2. Description of Service

BookingAddOn™ provides a SaaS (Software as a Service) platform that enables service providers to manage appointment bookings, process payments from their clients via Stripe integration, and access analytics about their business operations. As a service provider, you will have access to manage your calendar, view client appointments, and access business analytics.

3. Service Provider Eligibility

You must be at least 18 years old, have the legal capacity to enter into contracts, and operate a legitimate business to use the Service as a service provider. You represent and warrant that all information provided during registration is accurate, current, and complete.

4. Account Registration and Security

To use the Service, you must create a service provider account by providing accurate business information, including business name, contact details, and payment information. You are solely responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities conducted under your account
  • Notifying BookingAddOn™ immediately of any unauthorized access
  • Ensuring your account information remains current and accurate

5. Subscription Fees and Billing

Access to the Service requires payment of monthly subscription fees based on your selected plan (Solo, Practice, or Clinic). You agree to:

  • Pay all subscription fees in accordance with your selected plan
  • Provide valid payment information and authorize recurring charges
  • Understand that fees are non-refundable except as required by law
  • Accept that subscription fees may change with 30 days' written notice

6. Client Payment Processing

The Service integrates with Stripe to enable you to process payments from your clients. You acknowledge that:

  • You must comply with Stripe's terms of service (https://stripe.com/legal)
  • BookingAddOn™ does not store or process credit card information
  • You are responsible for all transactions with your clients
  • BookingAddOn™ is not liable for any payment disputes between you and your clients

7. Service Provider Responsibilities

As a service provider, you agree to:

  • Use the Service in compliance with all applicable laws and regulations
  • Provide accurate information about your business and services
  • Maintain professional standards in your interactions with clients
  • Handle client data responsibly and in accordance with data protection laws
  • Not use the Service for any unlawful, fraudulent, or unauthorized purpose
  • Not attempt to access, modify, or disrupt the Service's systems or other users' data
  • Not resell or redistribute access to the Service without authorization

8. Client Data and Privacy

You acknowledge that:

  • You are the data controller for your clients' personal information
  • You must obtain appropriate consent from clients for data collection
  • You are responsible for complying with applicable data protection laws
  • BookingAddOn™ acts as a data processor and will handle client data according to our Privacy Policy
  • You must have a privacy policy that accurately describes your data practices

9. Health Information Disclaimer (HIPAA)

BookingAddOn™ is not a HIPAA-covered entity and is not currently HIPAA certified. The Service is designed for wellness practitioners, coaches, massage therapists, acupuncturists, and similar professionals who are generally not classified as HIPAA-covered entities.

If you are a healthcare provider subject to HIPAA regulations, you acknowledge that:

  • BookingAddOn™ does not provide a HIPAA-compliant environment
  • You should not store Protected Health Information (PHI) beyond basic appointment scheduling data
  • You are solely responsible for your own HIPAA compliance obligations
  • BookingAddOn™ does not sign Business Associate Agreements (BAAs)

We take data security seriously and implement encryption, secure authentication, and access controls, but these measures alone do not constitute HIPAA compliance.

10. License and Intellectual Property

BookingAddOn™ grants you a limited, non-exclusive, non-transferable license to use the Service for your business purposes. All content, trademarks, and materials on the Service, including the BookingAddOn™ name and logo, remain the property of BookingAddOn™ or its licensors.

11. Service Availability and Support

While we strive to maintain continuous availability, BookingAddOn™:

  • Does not guarantee uninterrupted or error-free service
  • May perform maintenance that temporarily affects availability
  • Provides support based on your subscription tier
  • Is not liable for any losses due to service interruptions

12. Termination

You may cancel your subscription at any time. BookingAddOn™ may suspend or terminate your access to the Service:

  • For violations of these Terms
  • For non-payment of subscription fees
  • For fraudulent or illegal activity
  • At its discretion with 30 days' notice for any other reason

Upon termination, you will lose access to the Service and your data may be deleted according to our data retention policy.

13. Limitation of Liability

To the fullest extent permitted by law, BookingAddOn™ shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Damages arising from your use or inability to use the Service
  • Disputes between you and your clients

The Service is provided on an "as-is" and "as-available" basis without warranties of any kind, express or implied.

14. Indemnification

You agree to indemnify and hold harmless BookingAddOn™, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of third parties
  • Your interactions with clients

15. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of Panama, without regard to its conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Panama.

16. Changes to Terms

BookingAddOn™ reserves the right to modify these Terms at any time. Material changes will be communicated via email or platform notification at least 30 days before taking effect. Your continued use of the Service after changes constitute acceptance of the updated Terms.
